DOT to Reexamine Civil Penalty Rate for Corporate Average Fuel Economy Standards
NHTSA has opened a 90-day comment period.
According to a DOT news release, NHTSA is reexamining a rule that adjusts civil penalties due to the Corporate Average Fuel Economy (CAFE) standards for inflation.
Two notices have been published in the Federal Register, the first indicating the agency is reconsidering the December 28, 2016, final rule and seeks comment on the appropriate inflation adjustment. The second notice delays the effective date of the ruling during NHTSA's reconsideration period.
The delay of the effective date doesn't affect current penalty levels because they are not scheduled to increase until the 2019 model year, DOT noted.
