$142,100 Enforcement Case Involves Confined Space Violations

OSHA has filed 11 safety and health violations, including two classified as willful, against Dedicated TCS LLC.

An OSHA enforcement case against Dedicated TCS LLC includes $142,100 in proposed penalties and 11 alleged safety and health violations, including two classified as willful, mainly involving confined spaces. OSHA opened an inspection of the company's Lansing, Ill., facility, which cleans tank trailers, following a complaint.

OSHA's news release said Dedicated TCS is based in Lansing and has facilities in Channahon and New Orleans, La. The Channahon facility was cited in September for eight serious violations primarily related to permit-required confined space hazards, according to the release.

"A confined space has limited or restricted means for entry or exit, and it is not designed for continuous employee occupancy, which makes monitoring workers' activities in these spaces vital to their safety and health," said Gary Anderson, OSHA's area director in Calumet City. "OSHA is committed to protecting workers on the job, especially when employers fail to do so."

The alleged willful violations involve failing to provide a mechanical lifting device that could help rescue workers from confined spaces or having an attendant monitor the safety of workers operating within permit-required spaces.

The other nine violations, all classified as serious, include failing to test conditions in confined spaces; provide appropriate explosion-proof lighting; review entry operations; verify permit entries; sign permits to authorize entry; provide training for safe work in confined spaces; certify that training has been accomplished; and provide hazard communication and PPE training for workers exposed to contact with corrosive chemicals.
