Ohio Roofing Contractor Settles with DOL, Agrees to Pay $730,000 and Enhance Safety Measures

Charm Builders Ltd. has been the subject of repeated violations of workplace safety standards, particularly fall hazards, since 2009.

The U.S. Department of Labor (DOL) has finalized a settlement agreement with Ohio-based roofing contractor Charm Builders Ltd., stemming from a March 2022 investigation.

According to a recent release, the company agreed to pay $730,000 in penalties and institute improved safety measures. The settlement affirmed the 12 citations OSHA had identified, including six egregious-willful, five repeat and one serious violation. The agency noted a lack of fall protection and safety glasses, unsafe use of portable ladders and inadequate training on fall hazards.

Under the settlement, Charm Builders must hire a consultant to evaluate its safety program. This initiative includes implementing all recommended improvements, undergoing unannounced monthly site audits and submitting regular reports to OSHA. Additionally, the company must disclose all current and future work locations to OSHA, ensuring access for investigators.

In a statement, Blake McEnany, OSHA Area Director in Charleston, West Virginia, criticized Charm Builders’ repeated non-compliance with federal safety standards, deeming it "simply unacceptable." Since 2009, OSHA has cited the company 12 times, and the severity of these infractions led to the company's inclusion in OSHA's severe violators list in 2022.

Charm Builders—which specializes in roofing and siding—is headquartered in Millersburg, Ohio, and operates extensively across Ohio, Pennsylvania and West Virginia.
