Roofing Contractor Cited Following Second Worker Death in Three Years

In 2019, a worker of a roofing contractor was fatally injured from a fall. Now, the company is being cited following a second fatal fall of a worker this year. 

In February 2022, a worker was on a three-story roof in Spring Valley, New York, when they fell, according to a press release.

OSHA inspected the contractor, ALJ Home Improvement Inc., and found “ALJ failed to provide fall protection training or ensure effective fall protection safeguards were used” and did not ensure workers had eye protection for pneumatic nail gun use, according to the press release. OSHA cited ALJ for nine willful and three serious violations and proposed penalties of $1,343,363.

In 2019, a worker was fatally injured after a fall at another site. Since then, OSHA has cited ALJ for a total of 21 violations and proposed $299,425 in penalties.

“ALJ Home Improvement continues to ignore the law and callously exposes its employees to falls from elevation, the construction industry's deadliest hazard,” said OSHA Regional Administrator Richard Mendelson in New York in the press release. “Their repeated willful violations are evidence of an indefensible and inexcusable pattern of disregard for the safety of their employees. OSHA will continue to take strong enforcement actions against such employers."
