Comments Due by Oct. 27 on Canada's Proposed Vaping Regulations

Canadians are being asked to submit comments by Oct. 27 on the government's proposed regulation of vaping products. The government introduced its proposed act on Nov. 22, 2016, and began accepting comments Aug. 25, 2017. Its proposed act would amend the Tobacco Act, Non- smokers' Health Act, and other pertinent acts if it is adopted, with Health Canada to establish a first set of measures to regulate vaping products.

The agency seeks comments from consumers, the general public, health professionals, public health organizations, and also the vaping industry on proposed new packaging and labeling requirements for vaping products; information reporting requirements for vaping products, authorizing statements of relative health risk of vaping products, and advertising restrictions on vaping products.

For example, information that vaping device manufacturers would have to submit would include engineering drawings for devices, the contents of vaping liquids, information on R&D activities, and quarterly sales data. The proposal would require a displayed warning for products that contain nicotine -- and it says any product would be considered to contain nicotine if it is present at a concentration of 0.1 mg/ml or higher. Products that contain a vaping liquid would have to list all of their ingredients in descending order by weight.

Health Canada reports there has been a steady rise in the popularity of vaping products since their introduction about a decade ago, and it estimates the total vaping market in Canada to be in excess of $500 million. The number of brands and types of vaping products continues to evolve and new magazines, websites, and vaping conventions continue to be introduced, it says.
