Roofing Contractor Sentenced for Making False Statements to OSHA Inspectors

The statements were made following an incident that seriously injured three workers.

Marcus Borden, a steel and roofing contractor out of Russellville, Ala., has been charged with making false statements and lying to OSHA inspectors regarding an incident that lead to three workers getting seriously injured.

Borden told an OSHA inspector that he was present on the job site the day of the accident when a thunderstorm injured three workers who were working on a roofing project. He told an inspector that that he had obtained fall arrest equipment on March 13, when he actually retained the equipment on March 18, after the incident occurred, according to OSHA.

Borden also claimed that the workers were tied off, when he knew they were not.

"Marcus Borden provided false information to OSHA during the investigation and needs to face the consequences for his actions," said Kurt Petermeyer, OSHA's regional administrator in Atlanta. "The injuries sustained by the three employees could have been avoided if Borden had fulfilled his responsibility to ensure a safe working environment and provide the necessary protection to his workers."
