Per-Employee PPE Rule Before Kentucky Standards Board May 5

The Kentucky Occupational Safety and Health Standards Board will consider at its next meeting adopting OSHA's recent rule clarifying that employers have a compliance duty to provide respiratory protective equipment and training to each employee. The meeting is scheduled to begin at 1:30 p.m. Eastern time May 5 in the Nunn Room at the Galt House, Fourth Street and River Road in Louisville.

The board is part of the Kentucky Labor Cabinet, which has its headquarters in Frankfort and is headed by Labor Secretary J.R. Gray, a gubernatorial appointee.

Kentucky's Occupational Safety and Health Program is a state plan that was initially approved in 1973 and granted final approval in June 1985, becoming the first state plan approved under the revised federal benchmarks, according to OSHA. It has jurisdiction over both private- and public-sector Kentucky employers, with limited exceptions.

The Labor Cabinet was re-established on June 2, 2008 by Kentucky Gov. Steve Beshear's signing of Executive Order 2008-472, which re-established the agency, effective June 16, 2008, to streamline state services and concentrate limited resources on front-line regulatory activity.
