New Jersey Contractor Faces Over $1 Million in Penalties for Lack of Fall Protection

Since 2016, Adrian Construction Group LLC has been cited five times for similar violations.

New Jersey-based contractor Adrian Construction Group LLC is facing proposed penalties totaling more than $1 million, following the conclusion of a recent OSHA investigation.

According to a release dated Feb. 12, a July 2023 inspection at a construction site in Franklin Lakes, New Jersey was part of a local emphasis program on falls in the construction industry. OSHA investigators identified six willful violations relating to a lack of fall protection and eye protection. The agency also identified four serious violations tied to unsafe scaffolds and a lack of hard hats to protect workers from overhead hazards.

Adrian Construction Group has been the subject of OSHA investigations multiple times in recent years. In fact, since 2016 OSHA has inspected the company five times, citing it for similar violations regarding fall protection each time. As a result, the company is currently included in the agency’s Severe Violators Enforcement Program.

"Adrian Construction, under the ownership of Adrian Perea, continues to show a blatant disregard for the safety of their employees," OSHA Assistant Secretary of Labor Doug Parker said in a statement. "Placing them on the list of severe violators will intensify our scrutiny of their operations."

With proposed penalties of $1,017,248, Adrian Construction Group LLC now has 15 business days to comply with the citations, request an informal conference with OSHA's area director, or contest the findings before an independent commission.
