OSHA Suspends Recent Covid-19 ETS — What You Need to Know

OSHA has recently halted enforcement of their latest Emergency Temporary Standard to protect workers against Covid-19. Find out why and what you should be doing to prepare if OSHA gets the green light in our conversation with Tyson Horrocks, Of Counsel at Holland & Hart.

OSHA is under the national spotlight and even those who aren’t employers, safety professionals or even employees who are regularly meeting to discuss OSHA compliance rules—well, pretty much everyone knows about OSHA right now. And not only do they know about OSHA, they know what OSHA’s been up to the last few weeks.

Just as a quick debrief, back on November 4th, OSHA published its latest emergency temporary standard to protect workers from COVID-19. In that ETS, OSHA said that companies or organizations with 100 or more employees would need to encourage their workers to get their Covid vaccination. In addition to that, employers would need to log who has been vaccinated and who has not and, in the case that an employee was not vaccinated that employee must submit to regular testing.

Not long after the ETS was published, there was a lot of pushback from states and public officials. In this episode, Tyson Horrocks, Of Counsel at Holland & Hart helps to navigate listeners through what is going on with the ETS, as well as explain how states reacted to the ETS and ultimately why OSHA has recently announced it is not currently moving forward with enforcement efforts.
