Cal/OSHA Takes Emergency Action to Fund PSM Program

The emergency regulations announced Oct. 11 would implement a methodology for collecting an annual assessment to fund the state plan's Process Safety Management Program.

Cal/OSHA, the California Department of Industrial Relations’ Division of Occupational Safety and Health, has emergency regulations that would implement a methodology for determining and collecting an annual assessment to fund its Process Safety Management Program. The emergency regulations propose to adopt Article 12.5 of Subchapter 2, of Title 8, California Code of regulations, sections 344.76, 344.77, and 344.79.

This is a fast-track method established in the state's Government Code. After an agency submits proposed emergency regulations to the Office of Administrative Law, that office allows interested persons five calendar days to submit comments about them; OAL has just 10 calendar days after the filing to review and make a decision on the proposed emergency rule.

If it does approve, OAL files the regulations with the Secretary of State and they become effective for 180 days. Within that 180-day effective period, Cal/OSHA proceeds with a regular rulemaking action, including a public comment period.
