Alabama Trucking Company Named an Imminent Hazard to Public Safety

FMCSA has ordered J & L Trucking to stop all interstate and intrastate operations after determining the company was an imminent hazard to public safety.

The Federal Motor Carrier Safety Administration, part of DOT, has ordered J & L Trucking of Breatrice, Ala. to stop all interstate and intrastate operations after a federal investigation determined the company is an imminent threat to public safety. It operates just two trucks transporting general freight, according to the agency.

According to the agency's report, a truck operated by the company crossed the centerline on a highway in Fayette County on March 28, 2017, colliding with a passenger vehicle and killing both occupants. The truck driver admitted to falling asleep while driving.

At the crash site, law enforcement discovered the driver did not possess his records-of-duty-status for the preceding seven days and no medical certificate as required. After the crash, FMCSA's investigation found the company to be in violation of multiple federal statutes and regulations, including that it:

  • Failed to ensure its vehicles were regularly inspected, maintained, repaired and met minimum safety standards.
  • Failed to properly monitor its drivers to ensure compliance with maximum hours-of-service requirements.
  • Failed to comply with any driver qualification requirements, including ensuring its drivers were properly licensed and physically qualified to operate a commercial motor vehicle.
