Whistleblower Investigation Finds Illinois Central Railroad Co. in Violation of Federal Law

OSHA finds the company in violation of the Federal Railroad Safety Act

According to a press release from OSHA, the organization has found Illinois Central Railroad Co. in violation of the whistleblower provisions of the Federal Railroad Safety Act. OSHA found the company at fault for retaliating against a worker for reporting a work-related industry.

In this instance, the Illinois Central Railroad Co. worker sustained injuries to the head, neck and back “when falling into the bulkhead after the emergency break was applied unexpectedly on a moving locomotive,” according to the press release. The injuries were reported immediately and the conductor taken to the hospital, where he was diagnosed with a closed-head injury. The company then retaliated against the worker for reporting the work-related injury. OSHA has ordered the company to pay $1,000 in punitive damages and to take corrective action.
