FRA Delays Adjacent Track Rule's Effective Date to 2013
The final rule was scheduled to take effect May 1, 2012, but it is being delayed 14 months to accommodate railroads' training schedules.
The Federal Railroad Administration has delayed the effective date of its recent final rule requiring railroads to adopt on-track safety procedures in order to protect employees from being struck by trains or eqiupment moving on adjacent tracks. Scheduled to take effect May 1, 2012, it is being delayed 14 months to accommodate railroads' training schedules.
The new effective date is July 1, 2013. FRA's notice said two railroads filed comments, including one seeking the new effective date of July 1, 2013. FRA said it discovered while most railroads complete their annual training of roadway workers by May 1 every year, at least one doesn't complete its training by that date but would finish by July 1 of the calendar year.
The final rule was published Nov. 30, 2011.
