Free Webinar Covers ADA Changes

Two lawyers from Ballard Spahr's Labor and Employment Group are presenting a one-hour webinar April 7 discussing how employers should prepare for the new guidance and regulations taking effect May 24.

The regulations published by the Equal Employment Opportunity Commission in late March that implement the ADA Amendments Act of 2008 will significantly expand the number of Americans covered by ADA. Enacted by Congress to negate several U.S. Supreme Court rulings, the regulations set a lower threshold for a physical or mental impairment that "substantially limits" one or more major life activities, expand the definition of major life activities by adding a non-exhaustive list of "major bodily functions," and do not specify any specific minimum duration for the effects of an impairment to be deemed substantially limiting.

All of this means employers should be preparing now for how they will adjust their ADA policies and ADA medical questionnaires and should be scheduling training of their HR professionals and supervisors and managers, according to lawyers from Ballard Spahr's Labor and Employment Group, Brian D. Pedrow and Alexandra Bak-Boychuk, who will present a free, one-hour webinar on April 7 about the new regulations.

The "Defining 'Disability': New Regulations Implement ADAAA" webinar will take place from noon to 1 p.m. EDT.

"The final regulations substantially expand the scope of employee coverage under the ADA, putting greater emphasis on the interactive dialogue and accommodation process, rather than the threshold question of whether an employee has a qualifying disability," they say in an April 6 legal alert to clients about the changes.
